ORDER

The applicant was discharged on 01.10.1996 because he was in a Permanent Low Medical Category and no sheltered appointment was available for him. His medical category had been permanently downgraded on account of disability of Lumbar Spondylosis, the extent of which was assessed to be 20% for two years and attributable to military service. Claim for grant of disability element was rejected only because of interference by the PCDA (P). The said entity assessed the disability to be neither attributable to nor aggravated by military service. Learned counsel for the applicant has relied upon judgment of the Hon’ble Supreme Court in CA No.164 of 1993 Ex-Sapper Mohinder Singh Vs Union of India and others decided on 14.01.1993, to submit that the PCDA (P) could not have interfered with the finding of a duly constituted Release Medical Board. Notice. JS Lalli, DSGI, accepts notice on behalf of the respondents and waives service and seeks time to file reply.

Adjourned to 01.04.2027.
