ORDER

Heard counsel for the parties.

During the course of arguments, learned counsel for the applicant submits that earlier he has filed OA No.14 of 2023 for granting Special Family Pension, which is fixed for disposal on 06.1.2027. However, during the pendency of above OA, the respondents have granted Special Family Pension vide PPO dated 31.03.2021 (Ann.A-2) to the applicant.

Sh. J.S.Lalli, DSGI has taken the objection that the applicant ought to have claimed relief for grant of Ex-gratia also in the same petition and if he has waived of that relief, he can not file separate OA at any later stage under Order II Rule 2 CPC and Rule 10 of AFT (Procedure) Rules, 2008 to avoid filing of multiplicity of cases for the same cause of action.

Matter requires consideration and list this case along with previous OA No.14/2023 fixed on 06.01.2027 for disposal.
