Mr Prashant Shinde i/b M/s. A.B. Shinde & Co., Advocate for the Applicant. None for Defendants. Applicant Bank has filed Withdrawal Application I.A. No.1122 of 2026 supported by affidavit (exhibit-23) for withdrawal of the T.O.A. No.102 of 2023. Ld. Advocate for the Applicant submits that the matter has been amicably settled with the Defendants for a sum of Rs.3,75,00,000/-as per OTS Scheme and no due certificate has been issued on 09.04.2025. Now, the Applicant does not wish to pursue with this T.O.A. In light of the statement made by the Ld. Advocate for the applicant, the withdrawal of I.A. No.1122 of 2026 is allowed. Resultantly, T.O.A. No.102 of 2023 stands disposed of as withdrawn. The Applicant shall be entitled to refund of court fees as per Rules.
