ORDER
1. The applicant bank has presented this Interlocutory Application seeking permission of this Tribunal to withdraw the Original Application against defendant no.1. It is stated that the matter has been amicably settled between the applicant bank and defendant nos.2 to 4 as set out in the application.
2. Mr Patel submits that nothing survives in the Original
Application and permission to withdraw be granted.
3. Mr Kedia drew my attention to the consent terms where the request is made by the parties for return of the original documents tendered in evidence by the applicant bank which has to be returned. The request is also made to refund the court fee as per the Rules.
4. Interlocutory Application is allowed in terms of prayer clause (a) is allowed with no order as to costs.
