**BEFORE THE NATIONAL LOK ADALAT AT DEBTS RECOVERY TRIBUNAL NO.3 MUMBAI Saturday, this the 14th March 2026**
**MISCELLANEOUS APPLICATION NO. 14 of 2025**
Heard the Ld. Registrar. We all three members of the panel have gone through the documents made available along with the application for restoration of OA 640 of 2023 having lodging No. 2565/2022 Union Bank of India Vs Mukesh Enterprises.
Bank of Maharashtra in it's OA 86 of 2024 having lodging No. 640 of 2023 received 32.60 Lakh against their claim of Rs. 28,61,922/- as it is reflected in Award dated 03.03.2024 passed by National Lok Adalat.
However, it is brought to the notice of this panel that Bank of Maharashtra had filed two applications with two different numbers bearing OA 86 of 2024 & OA 640 of 2023 before the panel of National Lok Adalat dated 03.03.2024.
Accordingly, OA 640 of 2023 (Union Bank of India Vs Mukesh Enterprises) was wrongly withdrawn in the National Lok Adalat dated 03.03.2024. As mentioned in Para 1, OA 640 of 2023 was filed by Union Bank of India Vs Mukesh Enterprises.
None of us were sitting on panel that time. However, since it is an error in an Award passed in Lok Adalat dated 03.03.2024 it is required to be corrected by same forum as it is recommended by Hon'ble PO vide order dated 06.03.2026 to put up before the Lok Adalat.
We found that as per documents OA 640 of 2023 lodging No. 2565/2022 (Union Bank Of India Vs Mukesh Enterprises) the bank has never filed any withdrawal application with supporting affidavits so whatever the order passed by Lok Adalat in the case, cannot be considered as passed on the basis of record, therefore, we the panel pass the order to restore OA 640 of 2023. MA 14 of 2025 stands disposed off.
OA 86 of 2024 having lodging No. 640 of 2023 is already withdrawn on the date of National Lok Adalat i.e. 03.03.2024.
