ORAL ORDER

(As per Hon’ble Mr. B.V. Sudhakar, Administrative Member)

Through Video Conferencing:

2. The OA is filed for not releasing the terminal benefits of the applicant on retirement.

3. Brief facts are that the applicant retired from the respondents organization as Depot Store Keeper on 31.7.2019. Terminal benefits were not released without any valid reasons excepting provisional pension. Applicant submitted several representations but of no avail and hence, the OA.

4. The contentions of the applicant are that there is no disciplinary case or any criminal case pending against him to deny the retiral benefits. Applicant is suffering from ill health and took loans to meet financial contingencies. Not releasing retiral benefits even after a year is arbitrary and violative of Articles 14, 16 & 21 of the Constitution. Representations submitted have not been responded to.

5. Heard both the counsel and perused the pleadings on record.

6. Applicant retired on 31.7.2019 and the respondents are expected to release the terminal benefits in a reasonable interval of time. More than a year has lapsed without granting of retiral benefits and that too without informing the applicant as to why they have been withheld. Applicant claims that there is no disciplinary case or criminal case pending against him. Even representations submitted have not been attended to. In view of the submissions made by the applicant, respondents are directed to dispose of the representations cited in the OA within a period of 8 weeks from the date of receipt of this order in accordance with rules and as per law by issuing a speaking and reasoned order.

7. With the above direction, the OA is disposed of, at the admission stage without going into the merits. No order as to costs.
