1. 1. The applicant has moved M.A. 130/2024 for condonation of delay of 76 days in filing the Securitization Application.
2. 2. The learned counsel for applicant submitted that respondent has taken possession of secured asset and has illegally sold away the property as per sale notice dated 25.02.2023. The applicant being homeless and applicant no. 2 being single mother could not file the S.A. and there is no deliberate delay in filing the S.A. and now this M.A. has been moved for condonation of delay in filing S.A.
3. 3. The learned counsel for respondent has strongly opposed the above referred application of applicants and submitted that delay is deliberate and it is not a fit case for condonation of delay.
4. 4. In view of above submissions, I pass the following order :
**ORDER**
1. i. M.A. 130/2024 is hereby allowed and delay of 76 days is hereby condoned in view of reasons stated therein.
2. ii. I.A. Diary Nos. 1686/2024 & 86/2025 are to be decided on merits at the time of deciding the main S.A. ~~after final hearing.~~ <sup>LA</sup> Hence, applicant is at **VIKAS**

liberty to raise all the pleas of these IAs at the time of final hearing on S.A.
iii. Registry is directed to register the S.A.
iv. File be consigned to the records.
