1. The applicant has moved MA N0.29/2026 for restoration of the SA No.
5312024 which was dismissed in default on 10.02.2026 along with lA diary No.245212026 for condonation of delay in filing the present lVA.
2. The Ld. Counsel for the respondent Finance Company submitted that the applicant has no ground for restoration of the SA. The applicant has committed default in payment of the loan amount and total overdue amount Rs.'l 0,31,000/- and the possession notice has been issued to the applicant on 22.09.2026 and applicant is not entitled for any interim relief as well as for restoration of the SA N0.53/2024.
3. ln view of above submission, I pass the following order.
ORDER
i) The lA diary No.245212026 for condonation of delay in filing the present MA is hereby allowed for the reasons stated therein and MA N0.29/2026 is also allowed and SA N0.53/2024 is hereby restored at its original stag e, ii) The respondent Finance Company is also directed to defer the possession fixed for 6.10.2026 in case the applicant deposit Rs. 10,31,000i- by 5.10.2026, failing to which respondent Finance Company is at liberty to take possession of the secured asset fixed for 6.10.2026. iii) lA diary No.2500/2026 is also disposed of accordingly.
