M/s. Hotel Saideep Holiday Park & others
..Applicants
Versus
Bank of Baroda.
..Respondent
None for the applicant.
Mr. S.R. Vakil – Advocate for the respondent bank..
1. In this matter the learned counsel for the respondent bank submits that this Review Application Diary No.695/2024 has filed by the applicants for recalling the Judgment and Orders passed by this Tribunal in the Original Application No.893/2019 on 18th July, 2023
which was allowed with costs against the respondent Nos.01 to 11 and the Recovery Certificate has also been issued against the defendant Nos.01 to 11. However, the Recovery Certificate No.318/2023 has been disposed of on 19.07.2024 as the matter has been amicably settled between the parties under One Time Settlement Scheme.
The respondent bank has received entire amount as per settlement and also No Dues Certificate to that effect has been issued to the defendants. As such, nothing has to be recovered from the applicants in the proceedings.
2. The learned counsel for the respondent further submits that this RA Diary No.695/2024 filed by the applicants may be disposed of as infructuous.
