1. This is a MA Diary No.1033/2024.

2. In this matter it is submitted by the counsel for the appellant that this SA No.295/2023 was listed before the Tribunal on 21.02.2024. The Tribunal vide order dated 21.02.2024

disposed of the above SA as settled.

3. It is submitted by the learned counsel for the appellant that to recall the order dated 21.02.2024 being inconsistent with the factual position and devoid of any statement regarding settlement of the loan account made by the applicants, the SA be restored to its original stage.

4. The counsel for the non-appellant filed reply and strongly objected that the present applicant misleading the Tribunal byway of moving such type of application. The learned counsel for the bank admitted that the loan Account of the applicant has not been settled so far. The present MA of the applicant may kindly be rejected with costs.
