1. This is a M.A. Diary No.1427 of 2024.

2. In this matter it is submitted by the counsel for the appellant that this MA Diary No.1427/2024 was listed before the Tribunal on 08.06.2023 for arguments. The Hon. Presiding Officer vide it’s order dated 08.06.2023 dismissed in default the OA 68/2018 for non-prosecution.

3. It is submitted by the learned counsel for the appellant that no prejudice would be caused to any party if the OA

no.68/2018 is restored. The appellant approached this Tribunal as expeditiously as possible as there was no efficacious and / or alternative remedy available to him except filing of this M.A. The huge amount is due against the defendants and if on technical reason the matter is not heard on merit, the appellant bank will cause heavy financial loss.
