APPEAL No.5/2017

Anil Ramrao Dodal

..Appellant

Versus

Asset Reconstruction co India Ltd

Mumbai

..Non-Appellant

None for the Appellant.

Mr. A.A. Mishra – Advocate for the Non-Appellant.

Due to Covid 19 situation the matter is taken through Video Conference.

1. None appears for the appellant.

2. This is an Appeal against the order of the Recovery Officer filed by the person claiming himself to be the lessee in the property. The loan was taken in 2002 and according to the pleadings itself the lease was executed somewhere in 2008

only. Even if we go by the pleadings, the applicant is also trying to say that the mortgage of the property is for property bearing No. A57 whereas he is in possession of the property bearing No.A56. Even according to his own pleading, the lease was to expire in 2018 which has already expired so he is not entitled to remain in the property after expiry of the lease.

3. Be that may be, since the lease has already expired, I do not find any merit in this appeal.
