**ORDER**
The petitioners have filed present MA to condone the delay of 10 days in filing petition to restore SA 352/2025 in pursuance of the dismissal order dt. 20.08.2025.
In MA the applicants have submitted that petitioners could not file proof of service before this Tribunal on 20.08.2025. The applicants could not contact the Advocate to know the status of the case due to his ill health issue. The SA 352/2025 was dismissed on 20.08.2025. The non-appearance of the applicant on the date was neither deliberate nor intentional but was due to bone-fide and unavoidable circumstances.
In counter on 04.12.2025 the Respondent bank has submitted that the above petition is not maintainable as DRT cannot condone the delay of filing any petition.
The applicants have filed the above MA only to condone the delay of 10 days. In the interest of justice I allow this MA 96/2025 and condone the delay and direct the Ld. Registrar to register the MA to set aside the dismissal order if otherwise in order.
