**ORDER**

In the above MA the applicants has prayed to condone the delay of 79 days in filing an application for setting aside the order dt. 12.09.2025 in SA No. 197 of 2018 in the interest of justice.

In counter dt. 02.03.2026 the Respondent No.1 has prayed to dismiss the MA with costs.

Vide order dt. 02.03.2026 R2 is debarred from filing counter.

As per MA the applicant has submitted that the counsel of this petitioner was pre-occupied with the marriage of his daughter, the associate advocate engaged by the counsel of this Tribunal has not represented the matter on 12.09.2025 and in the result this Tribunal has dismissed the SA on 12.09.2025 for default.

Later on this fact came in the knowledge of the petitioner. Non appearance of the petitioner is not intentional.

In counter the Respondent has submitted that petitioner has not given reasons for inordinate delay and as such there are no merits in the above petition. Hence this MA is liable to be set aside.

After perusal of the record I find that SA 197/2018 is dismissed vide order dt. 12.09.2025. The applicant has filed the present petition to condone the delay of 79 days. As per MA the applicant counsel was pre-occupied in her daughter's marriage on the fixed date. Hence he could not attend the court.

On the basis above reason I condone the delay of 79 days with costs of Rs. 1000/-. I direct the Ld. Registrar to register the MA for filing the set aside dismissal order if otherwise in order and put up the record on 01.04.2026. In the interest of justice I direct the petitioner to deposit the above amount in Prime Minister Relief Fund within 07 days from the date of this order.
