**ORDER**
The applicant has filed the present MA to condone the delay of 69 days in filing the set aside petition for default order passed against the Applicant bank dt. 25.04.2022.
As per MA on the date fixed the counsel of the applicant bank could not attend the Tribunal as he was suffering from fever. On that date OA was dismissed due to no representation. Subsequently the case file was misplaced with other files. Non representation on 25.04.2022 was neither willfull or wanton. After perusal of the facts, evidences I find that applicant had explained the reason for delay. Hence in the interest of justice I condone the delay of 69 days in filing the set aside petition. Accordingly I allow MA 92/2022 without costs and direct the Ld. Registrar to register the MA filed by the applicant to set aside the default order.
