**ORDER**
In the present MA, the applicant has prayed to set aside the exparte order/decreed dt.24.02.2025 passed against the applicant in the OA 478/2020.
As per MA, the applicant received summons and filed Vakalatnama and requested Advocate to defend them. As per MA, applicant was not well for a while, he was not in touch with his counsel. This petitioner was debarred from filing written statement vide order dt.08.08.2024. The applicant has very strong case on merits.
In counter dt.09.10.2025, the OP has prayed to dismiss the MA with costs. As per OP, this MA is not maintainable. The applicant have not filed written statement also. The applicant may file appeal against the order of this Tribunal, but applicant has not filed any appeal before the Hon'ble DRAT, Kolkata.
Perused the record of this MA and also the record of OA 478/2020.
After perusal of the record of OA 478/2020, I find that this OA was fixed for written statement on 03.12.2022. On 25.04.2022, Sri. V. Satish, Advocate filed Vakalatnama on behalf of D1 and D2 and this OA was pending for written statement since 25.04.2022 to 14.05.2024 and at last on 08.08.2024, defendants left the Pairvi, hence defendant was debarred from filing written statement and case was fixed for adducing exparte evidence. The applicant bank adduced evidence and after hearing the applicant bank, final order was passed on 24.02.2025. After that, the applicant had filed the present MA on 03.04.2025.
In this case, the defendants appeared, filed Vakalat, and after giving more than sufficient opportunity, defendant did not file written statement and at last, defendant was debarred from filing written statement and after hearing, exparte order was passed in OA.
After analyzing the facts, I find that applicant has not given any proper reason for non-appearing in OA 478/2020. Explanation given by the petitioner of this MA is not just and proper.
On the basis of the above discussion, MA 33/2025 is dismissed on contest without costs.
