**ORDER**
In the above MA the applicant has prayed to set aside the dismissal order dt. 17.04.2024 by restoring the above SA 416/2023.
As per MA, SA was posted on 17.04.2024 for the notices of Respondent No.2. The Junior Counsel did not appear, SA 416/2023 was dismissed. Applicant has filed the present petition on 17.05.2024. SA 416/2023 is dismissed on 17.04.2024.
In counter the Respondent has prayed to dismiss the MA with exemplary costs.
As per respondent applicant has not approached this Tribunal with clean hands. After perusal of the record I find that applicant has filed present MA within time. Hence in the interest of justice order dt. 17.04.2024 is hereby set aside and I direct the Ld. Registrar to register the SA 416/2023 on its original No. and accordingly MA 90/2024 is hereby allowed on contest without costs. All connected IAs if any are also closed.
