**ORDER**
In the above M.A., the applicant has prayed to restore the S.A.No.314/2022 by setting aside the dismissal order dated 27.10.2023.
In the counter dated 13.03.2026, the OP/respondent bank has prayed to dismiss the M.A. with costs.
The applicant filed the above M.A.No.154/2023 on 02.11.2023. S.A.No.314/2022 was dismissed on 27.10.2023.
In M.A.No.154/2023, the applicant has submitted that she could not attend the court on 27.10.2023 due to ill health, and her counsel also could not represent the matter. Hence, S.A.No.314/2022 was dismissed for default on 27.10.2023.
In the counter, the OP/respondent bank submitted that the applicant has not paid the amount as per the direction of this Tribunal.
After scanning all the facts, I find that S.A.No.314/2022 was dismissed on 27.10.2023, and the petitioner has filed the present petition on 02.11.2023.

Hence, in the interest of justice, I allow M.A.No.154/2023 on contest without costs, and set aside the dismissal order dated 27.10.2023 passed in S.A.No.314/2022 and direct the Ld. Registrar to register the S.A.No.314/2022 on its original number. I direct the both parties to appear for hearing in the SA on 18/06/2026.
