**ORDER**
The applicant has filed the present MA and prayed to set aside the dismissal order dt.19.11.2025 passed in SA 73/2024 against the applicant in the interest of justice.
Perused the record. In this MA, no one appeared on behalf of the OP, hence OP is debarred from filing counter vide order dt.30.03.2026. Perused the record. SA 73/2024 is dismissed for default by this Tribunal on 19.11.2025. The petitioner has filed the present petition on 04.12.2025, hence this MA is within time and limitation period.
As per MA, the junior counsel of the applicant advocate got confused and could not represent the matter and file track report for service of notice to 3rd respondent and due to this reason, this Tribunal dismissed the appeal as applicant counsel did not show any interest in prosecution of the matter.
Since the petitioner has filed this MA within Limitation period and explanation given by the petitioner counsel reveals reliable.
Hence on the basis of the above discussion, MA 210/2025 is hereby allowed and order dt.19.11.2025 passed in SA 73/2024 is hereby recalled and I direct the Ld. Registrar to register the SA 73/2024 on its original number and send notice to the respondents in SA fixing the case on 17.07.2026. I also direct the petitioner to file necessary requisites for sending registered notice to the respondents in SA within three days before Registrar.
