Heard the Ld. Counsel of the applicant on MA 08/2026. On call, no one appeared on behalf of the OP/respondents. The OP/respondents have also not filed any counter as per previous order, hence OP/respondents are debarred from filing counter. Perused the record.
After perusal of the record, I find that OA 842/2021 is dismissed for default on 02.01.2026. The applicant has filed the present petition on 23.01.2026 which is within time. As per applicant, this case was fixed for WS. As per MA, applicant was busy in Civil Court and due to non-appearance, case was dismissed.
Since the matter was fixed for WS and the applicant counsel was busy in Civil Court, hence in the interest of justice, order dt.02.01.2026 passed in OA 842/2021 is here by set aside and accordingly, MA 08/2026 is allowed. I direct the Ld. Registrar to register the OA 842/2021 on its original number and send notice to defendants in OA and fix the case on 19.07.2026.
