**ORDER**
In the above MA the applicant has prayed to set aside the default order dt. 25.07.2024 passed against the applicant.
As per MA, SA No. 206/2021 was fixed for argument on 25.07.2024 and on that date SA was dismissed for default. Default was neither willful nor deliberate In counter dt. 11.08.2025 the Respondent bank has prayed to dismiss the MA. As per counter MA is not maintainable under law as alleged on the facts. The applicant has suppressed the material facts. All the facts stated by the applicant are false.
After perusal of the record I find that the SA 206/2021 was dismissed for default on 25.07.2024 and petitioner has filed the present petition on 02.08.2024, within time. The explanation for non appearance before the court given by the petitioner is reliable and trust worthy.
On the basis of above discussion MA 75/2024 is hereby allowed on contest without costs.
I direct the Ld. Registrar to register the SA 206/2021 on its original number. In this case both parties are present at the time of hearing MA 75/2024. Hence SA 206/2021 is hereby fixed for arguments on 24.08.2026.
