MA 203/25
**DEBTS RECOVERY TRIBUNAL**
VISAKHAPATNAM
MA 203/2025(set aside)
SA 564/2024
24.07.2026
Ms. K. A. Radha Kumari, Advocate, appeared on behalf of the applicant/petitioner. Ms. M. Uma Maheswari, Advocate, appeared on behalf of the respondent FI/OP.
Heard the Ld. Counsels for both parties on MA 203/2025 and its counter dated 25.06.2026. Perused the record.
In this above MA, the applicant/petitioner has prayed to set aside the dismissal order dated 09.10.2025 in SA 564/2024 passed against the applicant.
The applicant has further submitted that he could not present on date and case was dismissed for non-appearance. It was neither willful nor wanton.
In the counter, the OP/respondent has prayed to dismiss the MA. As per the OP/respondent, the applicant/petitioner has knowledge of the case. The petitioner/applicant failed to appear before this Tribunal on the fixed date. The petitioner/applicant has not explained the nature of the absent.
After perusal of the record, I find that SA 564/2024 was dismissed on 09.10.2025 but the applicant has filed the present this MA on ~~28.10.2025~~ 28.10.2025 within time. The explanation given by the applicant just and proper.
On the above discussion, MA 203/2025 is hereby allowed on contest without costs and set aside the dismissal order dated 09.10.2025 passed in SA 564/2024.
I direct the Ld. Registrar to register the SA 564/2024 on its original number. Both parties are present. Hence, fix the case for further hearing on SA, posted to 16/09/2026.
