**ORDER**
In the above MA the applicant bank has prayed to condone the delay of 52 days in filing an application to set aside the exparte order dt.23.04.2025 in the interest of justice.
As per applicant record was misplaced. The delay was neither willful nor wanton.
After perusal of the record I find that no one appeared on behalf of OP. OP is debarred from filing counter and reply vide order dt.17.06.2026.
After perusal of the record it is clear that due to misplace of record the above delay is caused. Hence in the interest of justice the delay of 52 days is hereby condoned and accordingly I allow MA 69/2025 and direct the Ld. Registrar to register the MA for setting aside the dismissal order and send notice to OP for filing counter if any on the set aside petition, fixing the case on 15.09.2026.
