**ORDER**

In the above MA, the petitioner has prayed to condone the delay of 1032 days in filing the set aside petition for dismissal order dt.24.08.2022 in the interest of justice.

\* Corrected as per orders dt. 23/9/26

As per MA, the petitioner had filed OA for recovery of an amount of Rs.71,65,911.47ps. The case was posted for adducing exparte evidence on 04.03.2020. The advocate by name Mr. N. V. Subba Raju, had not informed the bank authority about the progress of the case. After verification, it came to the knowledge of the bank that OA was dismissed for default on 24.08.2022.

Vide order dt.15.07.2026, the OP/respondents are debarred from filing counter.

OA 970/2018 was filed for recovery of Rs.71,65,911.47ps. From the record of MA, it reveals that the then Advocate had not informed about the progress of the case to the bank and at last on 24.08.2022, the OA was dismissed for default.

In the interest of justice, I condone the delay and direct the office to register the MA for filing set aside petition and accordingly allow MA 85/2025 with a cost of Rs.2000. I direct the petitioner bank to deposit this amount to the Prime Minister Relief Fund.

[Dictated to steno, transcribed by her, corrected and pronounced by me in the open court on this day of 22nd September, 2026]
