**ORDER**

The applicant has filed the present MA on 23.06.2026. In the above MA, the applicant has prayed to condone the delay of 2936 days in filing set aside petition for final orders dt.30.05.2017 in OA 737/2016 and allow the defendant to adduce defendant evidence in the interest of justice.

As per petitioner, he received demand notice from the recovery officer and then the final order of the OA came in his knowledge. In the case arguments are necessary. The non-appearance of petitioner before this Tribunal is neither willful nor wanton. After receiving the demand notice from the recovery officer, it came to the knowledge of the petitioner that OA 737/2016 was finally decreed on 30.05.2017 without filing defendant's evidence by the petitioner.

The respondent bank has filed counter on 20.08.2026. In counter, the respondent bank has prayed to dismiss the MA with exemplary costs. As per counter, OA 737/2016 was finally decided on merits and final orders were passed by this Tribunal on 30.05.2017. The delay is unexplained and inordinate. This petition is time barred by limitation. The applicant is a chronic defaulter and he has failed to repay the loan amount.

Perused the record of OA 737/2016. After perusal of the record, I find that vide order dt.27.02.2017, the defendants are set exparte and finally vide order dt.30.05.2017, exparte decree was passed against the defendants/petitioner of this MA. The petitioner has not explained the reason properly for the above inordinate delay.

On the basis of the above discussion, MA 67/2025 is hereby dismissed on contest without costs.
