**ORDER**
In the above MA, the petitioner has prayed to set aside the dismissal order dt.21.09.2023 against the applicant bank and restore the application for further proceedings.
As per petitioner, the OA was posted for filing written statement but counsel of the petitioner has noted the date as 22.09.2023 and thus the petitioner counsel could not attend the Tribunal and this OA was dismissed on 21.09.2023.
After perusal of the record, I find that OA 298/2023 was dismissed on 21.09.2023 and applicant has filed the present MA on 04.10.2023 within limitation period. The explanation for non-appearance given by the petitioner reveals to be trust worthy.
The respondent/OP is debarred from filing counter vide order dt.19.08.2026.
On the basis of the above discussion, MA 144/2023 is hereby allowed and direct the Ld. Registrar to register the OA 298/2023 on its original number and fix the case on 22.12.2026.
I direct Ld. Registrar to send the notice through registered post to the defendants for filing written statement on the date fixed. I also direct the applicant bank to file necessary requisites for sending notice to the defendants of OA.
