**ORDER**

In the above MA the applicant has prayed to condone the delay of 163 days in filing the restoration petition.

As per order sheet dt. 06.04.2026 R1 and R2 are debarred from filing counter. Vide order dt. 19.08.2026 R3 is also debarred from filing counter.

I have heard the Ld. Counsel of the applicant and perused the record. As per MA SA 296/2019 was filed by the husband of the applicant. During the pendency of SA husband of the applicant died leaving behind petitioner and her daughter as his class-1 legal heirs. On the fixed date 21.06.2024 no one appeared on behalf of applicant. Applicant had gone to Hyderabad to stay along with her elder daughter who is the 3rd petitioner.

After scanning the facts I find that the petitioner husband died and petitioner could not present before this Tribunal to prosecute the case. The explanation give by the petitioner in this MA reveals trust worthy. On the basis of above discussion I condone the delay of 163 days in filing the restoration petition and accordingly MA 13/2025 is allowed without cost.

I direct the Ld. Registrar to register the set aside petition if otherwise in order and sent notice to OPs of set aside petition. I also direct the applicant to file the necessary requisites for sending the notice in the Miscellaneous application **(Dictated to Steno, transcribed by her, corrected and pronounced by me in the open court on this 17th October, 2026)**
