**ORDER**
In the above MA, the applicant has prayed to set aside the order dt.04.03.2025 in the interest of justice.
As per applicant, on 26.05.2025, this Tribunal directed the petitioner to file the certified copy of the memorandum of deposit of title deeds and posted the matter to 25.06.2025. On that date, the petitioner sought time for filing the same as he could not receive the copy in time and subsequently, the matter was posted to 29.07.2025. On that date, the petitioner filed the certified copy of the documents along with memo. This Tribunal further directed the respondent to file evidence in rebuttal and posted the matter to 11.09.2025. On that date, no evidence was filed in rebuttal and the matter was posted for arguments on 15.10.2025. Again the matter was posted on 10.11.2025. On 10.11.2025, this Tribunal directed the office of SRO to produce the documents pertaining to the document No.1701/2015 and also directed the respondent bank to produce the original documents on 08.12.2025. On 08.12.2025, the staff of the SRO, Gannavaram, attended and filed the documents, hence, the matter was posted for arguments on 07.01.2026. Subsequently, the matter was posted to 04.03.2025. The applicant counsel could not appear due to chronic kidney disease and as such the above SA was dismissed for default. The applicant had already filed written arguments. The applicant has prayed to set aside the order dt.04.03.2025.
In this case, the OP/respondent bank is debarred from filing counter vide order dt.13.07.2026.
After perusal of the record, I find that SA 324/2020 is dismissed for default on 04.03.2026 but petitioner has wrongly mentioned the date as 04.03.2025. Since, SA is dismissed on 04.03.2026 and applicant has filed this petition on 18.03.2026, hence, this MA is within time.
Considering the nature of the case and submissions presented by the petitioner counsel, I direct the Ld. Registrar to register the SA 324/2020 on its original number and send notice to the respondents through registered post, and I also direct the applicant to file the necessary requisites for sending the notice and fix the case on 06.11.2026.
Accordingly, MA 30/2026 is allowed without costs.
