**DEBTS RECOVERY TRIBUNAL**

VISAKHAPATNAM

MA 01/2018

OA 624/2018

21.07.2022

Written arguments filed by the petitioner. Counter filed by the OP bank. Heard both the parties on MA 01/2018. In this MA the Ld. counsel for the applicant has prayed to set aside the exparte order dated 19.10.2017 passed against this petitioner and other defendants and restored the original application.

The OP bank has filed counter on the above MA, the OP bank has submitted that the petitioner wanted to delay the proceedings though they were aware of the proceedings pending against them, the ground raised by the appellants could not be upheld, the petition deserves to be dismissed in the interest of justice.

On 19.10.2017 exparte order is passed in OA 624/2016 and within time on 17.11.2017 applicant has filed this MA. In the interest of justice, I set aside the exparte order dated 19.10.2017 passed against this Petitioner and other defendants and I also restore the original application 624/2016 on its original number for hearing in OA as a last change. I fix the date on 26.07.2022 I direct the both the parties to complete the arguments on the fixed date, otherwise again an appropriate order will be passed.
