MA copy supplied to the Ld. Counsel for the respondent bank. Heard Ld. Counsel for the respondent bank present. On 13.05.2022. the applicant was present, no one appeared on behalf of the applicant. On repeated calls no one present on behalf of the applicant. Hence this OA along with IA if any are dismissed for default for non prosecution of the matter. The applicant has filed this petition on 06.06.2022 within time. In the interest of justice, I allow this MA and setaside the order dated 13.05.2022 passed in OA 779/2017. OA is restored and issue notice as well as issue paper publication against the defendants in OA 779/2017 posted to 14.09.2022.
