The applicant is working as Staff Nurse in the Beedi Workers Welfare Fund Dispensary, Nellore.
2. This OA is filed with a prayer to declare the action of the Respondents in not granting financial upgradation in respect of 3<sup>rd</sup> MACP by placing the applicant in Pay Band with GP Rs.6600/- with effect from 25.04.2015 and instead granting the benefit of only Rs.5,400/- as illegal, arbitrary and contrary to the order passed by this Tribunal in OA No.1537/2013, OA No.472/2016.
3. The applicant contends that she is entitled for extension of 3<sup>rd</sup> MACP in the form of placement in the relevant Pay Band with GP of Rs.6,600/-.
4. We have heard Mr. K. R. K. V. Prasad, learned counsel for the applicant and Mrs. K. Rajitha, learned Sr Central Govt., Standing Counsel for Respondents. Mrs. K. Rajitha, learned Sr Central Govt., Standing Counsel for Respondents submit that reply statement has been sent to the authorities for signature. We would have certainly waited till the respondents filed a reply affidavit but for the fact that the matter is squarely covered by number of orders passed by this Tribunal, we are proceeding with disposal

5. Initially an order was passed in OA No.1537/2013 directing extension of such benefit and thereafter it was followed in OA Nos. 214/2016, 229/2016 and 472/2016. In that view of the matter, we dispose of the OA directing that the Respondents shall extend the benefit of the GP of Rs.6,600/- to the applicant in case she is similarly situated as Smt. R. Ratna Kumari, the applicant in OA No.472/2016.
6. The exercise in this behalf shall be completed within a period of two months from the date of receipt of a copy of this order. OA allowed accordingly. There shall be no order as to costs.
