Since the matter pertains to family pension, which is a continuous cause of action, learned counsel for the respondents opposed the application on the ground of delay. However, having regard to the reasons stated in the M.A. and the documents supporting the averments made in the accompanying affidavit, the delay is condoned. Accordingly, M.A. No. 414/2024, filed seeking condonation of delay, is allowed. The Registry is directed to assign the proper number to the O.A. Issue notice to the respondents in the main O.A.
