CENTRAL ADMINISTRATIVE TRIBUNAL HYDERABAD (TELANGANA) NO. 5-10-193, 1ST FLOOR, HACA BHAVAN,HYDERABAD - 500004 Order Sheet Item no.: 1 M.A./336/2026 (ANDHRA PRADESH) [ MA FOR JOINING TOGETHER ] In Diary No.: 1431/2026 RECOVERY Court No.: 3 No of Adjournment: Order Dated: 25/09/2026 KOLLI VENKATA RANGA RAO Vs BSNL
For Applicant(s) Advocate : V RAVINDHAR
For Respondent(s) Advocate : P SARADA Order of The Tribunal Heard the learned counsel for the applicant. The applicant herein is seeking for the following interim relief:- “Pending disposal of the main case the Applicant herein prays that this Hon'ble Tribunal may be pleased to stay the operation of the impugned order No. BSNLCO- A/16(21)/16/2024-ESTAB dated 13.04.2026 issued by the 2nd Respondent, along with all consequential recovery notices and re-fixation memos issued by the 3rd to 10th Respondents against the Petitioners, and further direct the Respondents not to deduct, withhold, or recover any amounts from the monthly salaries and allowances of the Petitioners, and pass such other order or orders as this Hon'ble Court deems fit and proper.” Prima facie, the applicant has made out a case for grant of interim relief. Learned counsel for the applicant relies upon a decision passed by coordinate Bench, Chennai in O.A. No. 862/2026, dt. 20.07.2026, wherein, similar issue is pending for the consideration and interim releif had already been granted.
Mrs. P. Sarada, learned counsel appears and takes on behalf of the respondents, and opposes the grant of interim relief. In the facts and circumstances of the case, we are of the view that no prejudice will be caused if similar Interim Relief as granted by the coordinate Bench, Chennai in OA No. 862/2026, vide order dt. 20.07.2026, is extended to the applicant herein. The relevant portion of the order dt. 22.07.2026, is as under:- “The learned counsel for the applicant submits that the applicant had been appointed as TTA and joined on 22.07.2002 at Cheyyur Exchange. Later he was selected as JTO which has a higher responsibility & pay scale and joined duty at Guduvancherry as JTO on 06.04.2009 and presently he is working as SDE at Chennai Telephones. At the time of his appointment as JTO the initial basic pay was fixed at Rs.16,400/- in the Revised scale of Rs. 16400-40500 of without protecting his TTA pay of Rs.8300/- receiving in the Pre-revised scale of Rs.7100-200-10100. After the implementation of the Second Pay Revision Committee (2nd PRC) instead of fixing his pay at Rs.9850/- and the correspondent revised stage at Rs.22820/- in the El scale Rs.16400-40500 based on his TTA basic pay, the pay of Rs.19,020/- in the El pay scale fixed at par with other pure direct recruits. Thereafter the applicant submitted representation seeking pay protection and consequential financial benefits in accordance with the relevant BSNL rules order No. 5-31/2001-Pers.IV dated 23.06.2010 and order No.5- 21/2024/Estt-IV dated 11.11.2014. After several requests his request was accepted and his basic pay was revised in May 2015. The BSNL CO Letter No.1-07/2012 - PAT (BSNL) dated 28.03.2012 which relied upon by the 5th respondent was already quashed by the Principal Bench of this Tribunal vide the order dated 08.05.2015 and the another order No.5-31/2001-Pers-IV dated 20.05.2016 which was relied upon by the 5th respondent for revising and fixing the applicant's pay was already quashed by this Tribunal by its Common Order dated passed in OA. 1401 of 2017 and batch. The 5th respondent revised the applicant's pay that too without giving any show cause notice and any opportunity to the applicant to explain his case. Hence the applicant seeks for the following interim relief: "a. to stay the operation of the impugned orders of the proceedings in BSNLCO-A/16(21)/16/2024-ESTAB dated 13.04.2026 & 15.06.2026 on the file of the 3rd respondent and in AO PAY CHTD/ TTA to JTO (2007) BATCH/2026-27/1 dated @ Ch-600 001, the 04.07.2026 on the file of the 5th respondent pending disposal of the present original application and thereby render justice.
b. to grant an order of ad-interim injunction restraining the respondents from attaching the salary of applicant in the name of recovery of alleged dues or under any other name pending disposal of the present original application and thereby render justice." Prima facie the applicant has made out a case for grant of interim relief. Mr. M. Kishore Kumar, SPC takes notice on behalf of the respondents and vehemently opposes for grant of interim relief. Having considered the submissions made by learned counsel for the applicant and in the interest of justice, there shall be stay of recovery proceedings from attaching the salary of the applicant till the next date of hearing." The operation of the impugned order dt. 13.04.2026 is stayed till the next date of hearing. Respondents are directed to file reply on M.A. No. 336/2026, filed for joining together. In the meantime, Registry is directed to number the O.A. List the case on 18.12.2026.
