1. This application is filed by the applicant bank under Section 19(1) of Recovery of Debts due and Bankruptcy Act, 1993 (formerly Recovery of Debts Due to Banks and Financial Institutions Act, 1993) to issue a recovery certificate for a total sum of Rs.23,78,864.36p due as on 20.2.2019 under Light Commercial Vehicle loans consisting of a sum of Rs.11,85,183.74p due under loan account No.50779134 and a sum of Rs.11,93,680.62p due under Loan account No.50779615 together with interest thereon @9.01% p.a. and all other applicable overdue charges against the defendants jointly and severally from 20.2.2019 till the date of realization in full and sale of the schedule properties along with costs of this application.

2. The facts of the case as stated in the OA, in brief, are as follows:- The defendants approached the Applicant Bank seeking for a Light Commercial Vehicle Loan and the applicant after considering the same sanctioned the said loan facility to the tune of Rs.14,65,000/- under Loan Account Number 50779134. The Defendants have agreed to the terms and conditions of the loan facility and executed the loan agreement dated 25.9.2017. The defendants also executed other necessary loan documents to secure the above said loan. It is further submitted that as per the stipulated terms and conditions of the said loan agreement, the defendants were bound to repay the aforementioned loan amount along with interest at 9.01% per annum in 48 equated monthly instalments of Rs.36,464/- each, which would commence from 1.11.2017 and end at 1.10.2021. The defendants availed the said loan and purchased the

commercial vehicle morefully described in the schedule of properties and duly hypothecated the same in favour of the applicant bank.

3. It is further submitted that the defendants again approached the applicant bank seeking another loan to purchase a Light Commercial Vehicle and the applicant after considering the same, sanctioned the said loan facility to the tune of Rs.14,65,000/- under Loan Account Number 50779615. The Defendants have agreed to the terms and conditions of the loan facility and executed the loan agreement dated 25.9.2017. The defendants also executed other necessary loan documents to secure the above said loan. It is further submitted that as per the stipulated terms and conditions of the said loan agreement, the defendants were bound to repay the aforementioned loan amount along with interest at 9.01% per annum in 48 equated monthly instalments of Rs.36,464/- each, which would commence from 15.11.2017 and end at 15.10.2021. The defendants availed the said loan and purchased the commercial vehicle morefully described in the schedule of properties and duly hypothecated the same in favour of the applicant bank.

4. It is further submitted that the defendants failed to adhere to the terms and conditions of the loan agreement and defaulted in paying the legitimate dues on the respective dates. Hence, the applicant bank issued a legal notice dated 25.2.2019 demanding a sum of Rs.11,85,183.74p due as on 20.2.2019 under loan account No50779134 and a sum of Rs.11,93,680.62p due as on 20.2.2019 under loan account No.50779615, along with interest
