ORDER
1. This contemplated OA is filed by the applicant bank for recovery of a sum of Rs.68,67,045/- together with future interest and costs.
2. During the process of scrutiny of OA, a memo is filed by applicant bank stating therein that subsequent to filing of this OA, defendant’s loan account got regularised on
02.01.2024
23.11.2022 and in view of the same, the present OA has become infructuous. Hence applicant bank prayed that they may be permitted to withdraw the OA and also prayed for refund of eligible Court fee.
3. Copy of memo is sent to other side by post and applicant bank had furnished postal receipts evidencing the same.
4. Perused. Memo is taken on record. Allowed. In the result, this OA is disposed of as withdrawn by applicant bank in view of regularisation of loan account, however without costs. All other interlocutory applications, if any pending shall stand closed. Applicant bank to file appropriate application for refund of Court fee as per extant guidelines.
