:FINAL ORDER:

1. The present Original Application in short (OA) has been filed under section 19 of Recovery of Debts and Bankruptcy Act 1993 for seeking issuance of Recovery Certificate against the defendants for Rs.29,83,23,403/- (Rupees Twenty Nine Crore Eighty Three Lakh Twenty Three Thousand Four Hundred and Three only) with further interest thereon from the date of filing the Application till realization from the Defendants.

2. It is the case of the applicant that, the first defendant is a public charitable trust registered under the Indian Trust Act and the defendant Nos.2 to 5 are the trustees of the first defendant; with the second defendant as the Chairman and the third defendant as the Secretary. The second defendant is the husband of the third defendant and defendant Nos. 4 and 5 are children to defendant Nos. 2 & 3. The defendant Nos. 2 to 4 are guarantor/mortgagor and the 5th defendant is the guarantor to the liability availed by the 1st defendant trust.

3. The defendants availed the following credit facilities:

Sl. No. Facility with limit Sanctioned Date

Term Loan-I Account No.004100IC00024922 with a limit of Rs.18,50,00,000/- for its Hessarghatta Education Institution Project

All the three-term loan were sanctioned, as per common sanction letter dated 16.12.2015 and the same was revalidated, as per applicant bank’s letter dated 07.09.2016

Term Loan-II Account No.004100IC00024931 with a limit of Rs.4,20,00,000/- for its Kalyan Nagar Education Institution Project

Term Loan-III Account No.004100IC00024959 with a limit of Sarjapura

Car Term Loan-II bearing Account No.004100NG00025366 Rs.22.50 Lakhs for purchase of Toyota Innova bearing Registration No.Ka-05-M-3897; and 26.04.2017

Car Term Loan-III bearing Account No.004100NG00025375 – Rs.45.80 Lakhs for purchase of Mercedes Benz Car- E Class 250 CDI Engine bearing No.65192433166866 and Chassis No.WDD2120036L058904 29.05.2017

4. It is also the case of the applicant that, in view of the above financed credit facility, the defendants have executed necessary loan documents apart from the creation of security interest by way of mortgage and hypothecation over the Schedule property.

5. It is further contended that, despite availing the credit facilities, agreeing to service the loan amount promptly and regularly, the defendants failed in complying the same, resulting in default in repayment and consequentially turning the loan accounts as NPA.

6. In the above circumstances, the applicant approached this Tribunal by filing this OA seeking issuance of Recovery Certificate for the balance amount due in the account.

7. Despite, service of summons on the defendants, they failed to appear, resulting the defendants being set exparte on 08.10.2024.

8. The applicant had let in evidence through AW-1, who filed their Proof Affidavit reiterating the contentions taken in the OA and also produced Exhibits A3 to A47 and got the same marked in evidence.

9. Heard the Ld. Counsel for the Applicant and considered the contentions as taken in the OA in the light of documentary evidence and proof affidavit.

10. The following issues arise for consideration in this matter: i) Whether the applicant had succeeded in proving the OA claim as against the defendants? ii) What order are to be passed?

Both these issues are gone into and decided together.

11. The case put forth by the applicant in the Application remains unrebutted as defendants remained exparte. The evidence tendered by the applicant remains uncontroverted and undisputed. The evidences put forth by the applicant were found admissible and are sufficient to prove availment of credit facilities as stated in the TA and execution of mortgage deed and hypothecation agreement agreeing creation of security interest as claimed by the applicant bank and the defaults committed in the accounts. The liability of the defendants and the claim of the amount due is also proved by the above documents. The claim of the applicant is well within the limitation.

12. Since the OA claim is arrived at by calculating agreed rate of interest, penal interest/default interest, which this Tribunal considers as on the higher side, pendentalite and future interest is awarded at fixed rate.

13. Hence in view of the above finding which cover both the issues raised in this manner, this Tribunal is of the view that TA is to be allowed.

14. In the result, TA.No.04/2020 stands allowed,
