2 MA .No.42/2021

Counsels on record/appeared for:

Applicant : Sri. C. Manjunatha Respondent :

: ORDER ON MA 42/2021:

The applicant in the SA No.250/2020 has filed present MA No.42/2021 under section 22 (2) (g) of the DRT Act r/w Sec.17 of the SARFA & ESI Act 2002.

The present MA is filed on 13.12.2021 to set aside impugned order dated 05.10.2021 passed by this Tribunal SA.No.250/2020 along with IA.No.2827/2021, petition for delay of 34 days.

It is seen from the records there is no representation of applicant on 27.12.2021, 14.03.2022 and again on 23.05.2022. The Tribunal had clarified and gave last opportunity to the applicant to address the arguments, failing which MA would be dismissed for default. In spite of such direction and clarification none represents the applicant today in 1st and 2nd round, it appears that the applicant is not keen in prosecuting the matter and intends to drag on the matter.

4) It is pertinent to note that the MA is filed on 13.12.2021 and the applicant is not representing before this Tribunal to address the arguments. The Tribunal is under duty bound to dispose of the matter as expeditiously as possible.

3 MA .No.42/2021

Accordingly, MA.No.42/2021 stands dismissed for default. Interim order granted if any stands vacated. Any pending IA’s if any are disposed of in terms of this order. No order as to cost. (Dictated to the Steno (BL), after her transcription and necessary corrections, signed and Order is passed on this day 13th of July, 2022)
