SOURABH KUMAR

ORDER(Oral) PER R.S. DOGRA, MEMBER (J): At the outset, it has been submitted by the learned counsel for the applicants that since the issue involved in this case is identical one for all the applicants, their prayers to join together in a single application may be allowed; and is, therefore, allowed. Accordingly, M.A. No. 187/2026 filed for joint application is allowed.

2. The instant OA has been filed by the applicants praying for the following relief(s):– “8.1] To direct the Respondents to consider the case of the Applicants by re-engaging them in the Group 'D available vacant post in N.F. Railway particularly under the Respondent Nos. 2 & 3 in the light of similar situated cases. 8.2] To direct the Respondents to consider the representations made by the Applicants to re-engage them under the Respondent No. 2 and 3. 8.3] Any other relief (s) that may be entitled to the Applicant. 8.4] To pay the cost of the case to the Applicants.”

3. The brief facts of the case are that Applicants are local educated unemployed youth of Haflong, Cachar, Hailakandi, Sonitpur & Sribhumi District of Assam. They were selected as Group- 'D' staff in the office of the Respondent Nos. 2 & 3. They

were engaged by the Respondents since 1990 under Senior Divisional Railway Engineer (Coordination) N.F. Railway, Lumding from time to time with artificial break. They were discharging their duties with utmost sincerity, honesty and best of abilities. The duties assigned to them were performed by them without any blemished from any quarter. During their services under the respondents, the applicants had acquired the eligibility criteria for regularization of their services. The Indian Railways requires large number of casual labourers for regular maintenance works and new projects. The casual labourers engaged in maintenance works are called open line workers and those engaged in project works are called project workers. These casual labourers are engaged and disengaged periodically depending upon the nature of works. During their service tenure, they had made request to the competent authority for their conversion to regular employees. However, Respondents had discharge them from their services, even after such discharge, they were continued to perform their duties with some artificial break. As per rules, the Respondents are duty bound to maintain a live Register of the casual and ex- casual workers to provide the work as per Seniority. Large numbers of ex-casual labourers were absorbed from the

SOURABH KUMAR

interpolated seniority list of ex-casual labourers, the instant applicants had submitted series of representations before the Respondents seeking their re-engagement under the Respondent Nos. 2 & 3. It is to be stated that some of the representations submitted by the similarly situated ex-Casual labours were screened by the Respondents leading absorption of many ex-casual labourers in group 'D' categories without considering the cases of the instant applicants. As per the applicants, similarly situated persons have approached this Tribunal through Original Application No. 37 of 2022 (Shri Haren Das & 122 others -Vs- Union of India and Another) and after hearing the matter, this Tribunal was pleased to allow the said О.A. As such, being on the same footing, respondents may be directed to consider the pending Representations of the Applicants by treating this O.A. as a part of it. Hence, this Original Application for seeking justice into the matter.

4. However, learned counsel for the applicants has submitted that it would suffice applicants’ purposes, if a direction be given to respondents to dispose of the pending Representations of the Applicants within a stipulated period of time.

SOURABH KUMAR

5. Learned Addl. CGSC for the respondents has no objection to the aforesaid submission.

6. In view of the above, respondents are directed to consider the pending Representation dated 12.12.2025(Annexure-A/1) of the applicants by treating the instant OA as a part of it and decide the same by passing a reasoned and speaking order within a period of three months from the date of receipt of a copy of this Order.

7. Accordingly, OA stands disposed of.

8. It is made clear that this Tribunal has not expressed any opinion on the merits of the case.

9. Pending M.A.(s), if any, also stand disposed of.
