BRIEF FACTS

2. The Averments made by the Applicant Bank in the Application are stated as follows:

2.1. The Defendants approached the Applicant Bank and gave Loan Application on 20.03.2006 for Agricultural Term Loan for the purchase of John Deere 5310 Tractor, Trailer and its Accessories. The Applicant Bank sanctioned the loan for a sum of Rs.7,34,000/- to the Defendants on the same date vide Sanction Memorandum dated 20.03.2006. The Defendants executed necessary documents in favour of the Applicant Bank, such as i. Memorandum of Agreement for Agricultural Loan dated 24.03.2006, ii. Agreement Relating to Deposit of Title Deeds dated 22.03.2006 for security for the loan availed, on and 10.03.2011, the Defendants executed Acknowledgement of Debt and Security in favour of the Applicant Bank.

2.2. The Rate of interest payable on the amount of loan under Agriculture Scheme has been revised from time to time as per Guidelines of Reserve Bank of India and Bank Guidelines. The Defendants are liable to pay interest at the rate of 15.50% towards 3 TA 903/2019

Agriculture loan together with penal interest at the rate of 2% per annum.

2.3. The Defendants to repay the liability in defaulted manner. As such the Accounts became irregular and classified as Non Performance Assets. Inspite of repeated Demands and several reminders made by the Applicant Bank to the Defendants, the Defendants did not pay the due loan amounts. The Defendants are liable to pay a sum of Rs.16,66,660/- with interest at the rate of 17.50% with compounded monthly rests from the date of Application, till the date of its realization. Therefore, the Applicant Bank filed this OA against the Defendants for recovery of the OA amount, and this Hon’ble Tribunal may be allowed the OA with Costs.

3. The Averments made by the 1st Defendant in the Reply Statement and the same is adopted by 2nd Defendant are stated as follows:

3.1. The Applicant Bank suppressed the various payments by the 1st Defendant and claimed more interest than mentioned in the Demand Promissory Note and the Hypothecation Agreement.

3.2. The Person who represents the Applicant Bank has no locus standi to plea and signs the Original Application. Therefore, the alleged Power of Attorney is not produce before the Hon’ble Tribunal. The Applicant Bank is liable to prove the same by documentary evidence.

3.3. The Loan Application of the 1 Defendant dated 20.03.2006, sanction of the loan of Rs.7,30,000/- to the Defendants and the alleged execution of Memorandum of Agreement for Agricultural Loan dated 24.03.2006 are all denied. In these circumstances, the alleged statement of accounts is liable to be proved by the proper documentary evidence. The Applicant Bank could not avail the benefits of the Bankers Book Evidence Act, in respect of the alleged Statement of Accounts. The claim in respect of Tractor Loan is not sustainable, since it is calculated by the interest more than mentioned in Demand Promissory Note and Hypothecation Agreement and the Reserve Bank Guidelines.

3.6. The “A” & “B” Schedule properties of the Original Application are not correct. As per the Directions of the Reserve Bank of India, the loan amount upto Rs.20,00,000/- to be referred to the Lok Adalat instead of filing case. As such this OA is liable to be dismissed. The 1st Defendant is an Agriculturist, therefore, he is entitled to get the benefits of Debt Relief Act. Therefore, the 1st Defendant prays this Hon’ble Tribunal, the OA may be dismissed with exemplary costs.

5 TA 903/2019

A cumulative analysis of both the Proof Affidavit and Documents marked by the Applicant Bank would prove the claim of the Applicant Bank in the OA.
