Presiding Officer

**03.09.2026**

The present Chamber Appeal is filed by the Applicant Bank challenging the order dated 18.05.2026 passed by the learned Registrar, whereby the OA filed by the Applicant Bank was declined to be registered for non-compliance.

There is a delay in filing the present appeal. The applicant bank has filed an application seeking condonation of delay. Heard the learned counsel for the Applicant Bank and perused the records.

The case of the Applicant Bank is that the Tribunal website reflected 05.05.2026 as the date fixed for compliance. However, according to the applicant, the OA. D.No.1993/2026 did not find place in the cause list published for 05.05.2026. It is further submitted that the applicant bank, on verification on 07.06.2026, came to know that the OA had in fact been declined registration by the learned Registrar vide order dated 18.05.2026.

..Contd..

The present Chamber Appeal was thereafter filed on 18.06.2026.

The explanation furnished by the Applicant Bank for the delay has been considered. The discrepancy stated to have existed between the date reflected on the Tribunal website and the cause list, coupled with the Applicant's assertion that it came to know of the order dated 18.05.2026 only upon verification on 07.06.2026, constitutes a circumstance which merits consideration in favour of the Applicant.

It is settled that while considering an application for condonation of the delay, the expression "Sufficient cause" is required to receive a liberal and pragmatic interpretation so as to advance substantial justice, provided the explanation is bonafide and not attributable to deliberate negligence or malafides.

In the facts and circumstances of the case, the Tribunal is satisfied that sufficient cause has been shown for the delay in filing the Chamber Appeal. The delay is accordingly condoned.

Register the Chamber Appeal.

On merits, the impugned order dated 18.05.2026 declining registration of the OA is founded upon the alleged non-compliance of the office objection/direction. Since the applicant bank has raised a specific grievance regarding the discrepancy between the date reflected on the Tribunal website and the cause list, the matter deserves to be reconsidered rather than being shut out on a procedural ground.

Accordingly, the order dated 18.05.2026 passed by the learned Registrar declining registration is set aside.

The matter is remitted to the learned Registrar for reconsideration. The applicant bank shall comply with the outstanding office objections, if any, within two weeks from the date of this order.

Thereafter, the learned Registrar shall consider the OA for registration in accordance with law.

D.No.1993/2026

..Contd..

It is made clear that this Tribunal has not expressed any opinion on the merits of the on OA or on any objection that may otherwise be raised by the defendant (s).

The Chamber Appeal is accordingly allowed in this above terms.
