HDFC BANK vs GREEN LEAF SUPER MARKET on 17 September 2026
**17.09.2026.**
The present Chamber Appeal has been filed by the applicant challenging the order dated 18.05.2026 passed by the Learned Registrar, where by the Original Application was declined to be registered on account of non-compliance of the office objections. Along with the Chamber Appeal, the applicant has also filed an IA no. 2707/2026 seeking condonation of 13 days' delay in filing the Appeal.
Learned counsel for the applicant submits that the Registry had granted time up to 17.07.2026 for compliance of the office objections. However, before expiry of the time so granted, pursuant to the notice dated 07.05.2026, the impugned order dated 18.05.2026 came to be passed declining to register the Original Application.
It is therefore submitted that the applicant was under a bonafide belief that the objections could be complied with within the time granted by the Registry and that the Original Application would there after be placed for registration. The applicant contends that the delay of 13 days in filing the present appeal was neither intentional nor deliberate.
Heard the learned counsel for the applicant and perused the records.
From the material placed on record, it appears that the Registry had indicated 17.07.2026 as the date for compliance of the office objections, whereas the impugned order declining registration of the Original Application was passed on 18.05.2026. Thus the applicant had been given an indication of time for compliance extending beyond the date on which the impugned order came to be passed. In such circumstances, the explanation offered by the applicant for the delay of 13 days in approaching the Tribunal cannot be said to be wholly lacking and bonafides.

It is well settled that while considering an application for condonation of delay, this Tribunal is required to adopt a pragmatic approach, particularly where the delay is short and the explanation furnished discloses sufficient cause. At the same time, condonation of delay cannot be claimed as a matter of right and the applicant is required to demonstrate sufficient cause for not approaching the Tribunal within the prescribed period.
In the present case, the delay is only 13 days and the circumstances stated by the applicant, particularly the discrepancy between the date fixed for compliance of office objections and the date on which the order declining registration was passed, constitute sufficient cause for condoning the delay.
Accordingly, the IA seeking condonation of delay of 13 days is allowed and the delay in filing the Chamber Appeal is condoned.
Register the Chamber Appeal. Coming to the Chamber Appeal, since the impugned order dated 18.05.2026 has been challenged on the ground that the applicant was granted time up to 17.07.2026 for compliance of the office objections, it would be appropriate to examine whether the Original Application could have been declined registration before the expiry of the time granted for such compliance.
In the circumstances, the impugned order dated 18.05.2026, passed by the learned Registrar declining registration of the Original Application is set aside. The matter is remitted to the Registry to consider the office objections and the compliance furnished by the applicant and to process the Original Application for registration in accordance with law.
The applicant shall comply with all the office objections, if any, within a month from the date of this order. Upon compliance, the Registry shall scrutinize the Original Application and if otherwise in

order, proceed with the registration in accordance with the Rules.
The Chamber Appeal stands allowed accordingly.
