D.NO.2002/2026
..Contd..
The Period stipulated by the Tribunal has expired. However, Applicant has neither complied with said condition nor placed any material on record explaining the failure to depositing the costs within the prescribed period. No Application seeking extension of time or modification of the condition has also been filed.
The condition imposed by the Tribunal while allowing the IA was mandatory and constituted a condition precedent for availing the benefit of the order. Having failed to comply with the said condition within the time granted, the Applicant cannot seek to take advantage of the order without fulfilling the condition attached thereto.
Accordingly, the conditional order dated 23.09.2026 has not been complied with and the benefit granted thereunder cannot be availed by the Applicant.
Hence, IA No.2875/2026 seeking condonation of delay stands dismissed for non-compliance of the condition imposed by the Tribunal. Consequently, the Chamber Appeal also stands dismissed as barred by limitation.
