For the reasons stated in the memorandum accompanying MA 4/2023 and on hearing Ld counsel for the petitioner, this Tribunal is convinced that there was sufficient reason for non-appearance of the applicant in SA 301/2021 on 21.12.2022. A party shall not be prejudiced for the act of the counsel for him. Hence, MA 4/2023 is allowed. SA restored to file.
