This Chamber Appeal has been filed by the Applicant bank on 12.06.2025 against the order of Ld. Registrar dated 31.05.2025 passed in Miscellaneous Application diary No.139 of 2025 whereby Ld. Registrar declined to register the Miscellaneous Application on the grounds that limitation aspect is not clear, additional parties not added on DRT portal, M.A. Title is not in accordance with Memo of parties and case was listed on multiple dates but the Ld. Counsel for Applicant failed to remove the defects.
Heard Ld. Counsel for the Applicant Bank and perused the Miscellaneous Application. The prayer of the Applicant Bank is allowable. Hence, allowed.
The Applicant Bank is directed cure all defects within the period of 15 days from today. If the Applicant Bank shall not cure the defects within the time prescribed, it shall be presumed that the Applicant Bank is not interested to pursue the matter and this order shall have no effect after that period.
It is also pertinent to mention here that in the prayer, the applicant bank has mentioned in petition for recall of order of Original Application but the recall application is for Miscellaneous application, the said defect also be cured.
Chamber Appeal No. 03 of 2025 is disposed of accordingly.
Let the Miscellaneous Application be restored to its original number after curing the defects.
