This Chamber Appeal has been filed by the Appellant on 17.06.2025 in relation to order passed by Ld. Registrar on 21.04.2025.
It is stated by the Appellant that the Appellant had filed the case before the Tribunal against the action of the respondent bank, subsequent to the filing of the Securitization Application, the Appellant's counsel due to unforeseen circumstances remained unaware of the defects that had been pointed out in the SA and order dated 21.04.2025 passed by Ld. Registrar came to our knowledge on 16.06.2025 only upon verification of the case status through website that the matter is dismissed by the Ld. Registrar and lastly prayed that the order dated 21.04.2025 be recalled and the Appellant may be allowed to cure the defects pointed out by Ld. Registrar.
Heard Ld. Counsel for the Appellant and perused the Securitization Application. The prayer of the Appellant is allowable. Hence, allowed.
The Appellant is directed cure all the defects within the period of 30 days. If the Appellant shall not cure the defect within the time prescribed, it shall be presumed that the Appellant is not interested to pursue the matter and this order shall have no effect after that period.
Chamber Appeal No. 01 of 2025 is disposed of accordingly.
Let the Securitization Application Diary No. 35 of 2025 be restored and the Appellant shall cure the defects before Ld. Registrar.
