Called out, Ld. Counsel for Applicant present. Ld. Nodal Officer of respondent bank present.

The Applicant has submitted a slip about deposition for Rs.2.00Lacs on 14.05.2026. As per Ld. Nodal officer the auction dated 28.01.2026 has failed. The Applicant wants to get unwarranted relief by filing Miscellaneous Petition even though decided on 14.01.2026 with a direction for repayment of 25% against demand notice. The applicant was duty bound to submit amount before 22.01.2026. The Applicant is playing a game of wait and watch. This practice cannot be permitted to any litigant or the borrower specifically in financial matters.

As per Ld. Nodal Officer of respondent bank the amount due against the applicant is approximately Rs.18.00Lacs after adjustment of the amount which is deposited on 14.05.2026. The applicant shall repay a minimum amount of Rs.5.00Lacs within a period of 15 days from the date of this order and shall submit proposal in relation to repayment of rest amount before the bank authorities in what manner the applicant shall repay first.

If the applicant shall fail in compliance of this order even though not entitled for the said relief due to non-compliance of order passed by the Tribunal dated 14.01.2026 but once more opportunity is provided for the ends of justice to the applicant.

If the applicant shall fail in repayment of amount as per this order, the respondent bank shall be free to take action in relation to recovery of amount under SARFAESI Act as well as RDDB Act according to law.

In the light of above observations, the petition is disposed off. No order as to cost.

Interim order, if any vacated. All Interim Applications are disposed off in the light of above.

Record be consigned.
