**Mrs. Manjit Kaur Vs. Shubham Housing Development Finance company Ltd. & Anr.**

**Date: 17.09.2026**

Item No.28

Present: Sh. B. B. Sharma, Ld. Counsel for Applicant Smt. Taruna Chaudhary, Ld. Counsel for Respondent F.I.

Called out, Ld. Counsel for parties present.

Ld. Counsel for Respondent F.I. has stated that the title deed of the secured assets has already been provided to the borrower/mortgagor. Ld. Counsel for Applicants has stated that the officer of the Respondent F.I. had obtained signature of the borrower/mortgagor, but no title deed of secured assets has been provided to the applicant/borrower/mortgagor. But nothing has been mentioned like statement made by Ld. Counsel for Applicants today in the application moved by the applicant. Specifically mentioned that the applicants are repeatedly approaching the Respondent F.I. for the original documents/original sale deed etc, but the Branch Manager is avoiding to return the documents along with original sale deed etc to the applicants on the one pretext or the other and on the basis of said version prayer has been made for the direction to return the original documents of the mortgaged property to the applicant forthwith.

The applicant has placed two stories in relation to the title deed of secured assets, one in writing on oath by submitting affidavit in support of the version and other stated orally today. Oral statement has no worth against the written statement on oath. In the light of above, there is no reason to disbelieve the statement of Ld. Counsel for Respondent F.I. about providing title deeds of secured assets has already been provided to the applicant as admitted by the Ld. Counsel about signature for receiving title deed.

In the light of above, the petition is liable to be disposed off, hence disposed off accordingly.

Interim relief, if any vacated. All Interim Applications are disposed off in the light of above.

Record be consigned.

(Umesh Kumar Sharma) Presiding Officer DRT, Dehradun
