The proposal submitted by the Applicant cannot be treated appropriate which was submitted in May, 2024 and the settlement proposal submitted on 10.06.2024 at the amount of Rs.8.00Lakh, the situation has shown that the Applicant wants to kill time only, not ready to settle the matter in appropriate manner, this practice cannot be allowed to any litigant or borrower. The Applicant is directed to repay Rs.1.00Lakh per month, if the Applicant shall not comply this order the Respondent Bank shall be free to taken action for recovery under S.A.R.F.A.E.S.I. Act as well as under RDDB Act. The Respondent Bank is also directed to charge interest in the reasonable manner, if possible to grant some relief in relation to the amount in question or interest, consider amicably and grant relief accordingly.
This petition is disposed off in the light of above observations.
Interim relief, if any, in this M.A. or S.A. No. 47 of 2021 on the basis of which this application has been filed by the applicant is vacated. All interim applications, if any also disposed off accordingly.
This order shall be fully final in relation to the S.A. No. 47 of 2021.
Record be consigned.
