The Securitization Application No. 19 of 2023 Ravinder Kumar Vs. Authorized Officer India Shelter Finance Corporation Ltd & Ors. was dismissed in default in absence of the Applicant on 26.06.2023. The application for restoration of Securitization Application and recall of the said order has been filed by the applicant on 26.07.2023.
The applicant has pleaded that the applicant and his advocate were coming together in bus from Roorkee and due to heavy rain and traffic they have been late in reaching the Tribunal at the time of hearing, due to that, the case has been dismissed in default as none was present at the time of hearing. It is prayed that the applicant has not committed any wrong knowingly and lastly prayed for recall of order dated 26.06.2023.
Ld. Counsel for Respondent F.I. has stated that the Respondent F.I. has no objection in relation to restoration of the application as the applicant has prayed due to being late the applicant could not reach on time and the petition ~~has~~ also been filed within time i.e. within 30 days.
As the prayer of applicant is allowable due to inadvertent situation the applicant could not be appeared. The prayer is allowed.
Securitization Application No. 19 of 2023 Ravinder Kumar Vs. Authorized Officer Shelter House India & Ors is restored to its original number.
M.A. No. 50 of 2023 is disposed off accordingly.
