Ld. Counsel for the Applicant Sh. Vivek Kumar with Applicant in person present. Ld. Counsel for Respondent Bank Sh. Nishant Chaturvedi with Ld. Manager(Law) Sh. Devesh Verma present.

Ld. Counsel for the Applicant has stated that the applicants want to settle the matter and proposed an amount of Rs.10.00Lacs(Rupees Ten Lacs only). On the other hand, Ld. Counsel for Respondent Bank argued that the Respondent Bank has already granted relief to the applicants in relation to expenses and penal interest, so the Respondent Bank is entitled for Rs.12,86,350.20ps(Rupees Twelve Lacs Eighty Six Thousand Three Hundred Fifty and Twenty paisa only).

After discussion, the applicants are ready to settle the matter at Rs.11.00Lacs(Rupees Eleven Lacs only). The matter has been considered by the Bench and feels, it shall be fruitful for both the parties that the matter be settled amicably. There is no more difference between the parties and an amount of Rs.12.00Lacs(Rupees Twelve Lacs only) shall be appropriate for both the parties for settlement. If the amount received today or tomorrow to the Respondent Bank, in that case, the Respondent Bank shall be in a good position in absence of recovery of amount stated by Ld. Counsel for respondent bank.

The matter is settled at the amount of Rs.12.00Lacs(Rupees Twelve Lacs only) and applicants are ready to repay today the said amount. After receiving the demand draft in relation to settlement amount of Rs.12.00Lacs(Rupees Twelve Lacs only), the Respondent Bank shall retransfer physical possession of the property today or tomorrow not later that i.e. if the applicants shall provide demand draft today in that case tomorrow i.e. on 15.11.2025. In case the applicant shall provide demand draft on 15.11.2025, the Respondent Bank shall provide physical possession/retransfer physical possession on 17.11.2025.

The matter is disposed off in the light of above observations and applicants are agree to provide demand draft today and provided a demand draft of Rs.12.00Lacs DD No.770033 dated 14.11.2025 which has been received by Ld. Law Officer of respondent bank, so the respondent bank is directed to receive demand draft today and provide repossession to the applicants by tomorrow, maximum within a week.

If possible for the respondent bank repossession today, in that case, the situation shall be fruitful for the Financial Institution.

The respondent bank is directed to provide title deed etc and the connected documents for which applicants are entitled shall provide within a period of 15 days from today to the applicants.

In the light of above observations and settlement between the parties, the petition is disposed off. No order as to cost.

Interim order, if any vacated. All interim applications are disposed off accordingly.

Original copy of this award is forwarded to Ld. Registrar, Debts Recovery Tribunal, Dehradun for placing on record as the case is disposed off finally in the light of settlement between the parties.

Let copy of this judgement be provided to the concerned parties or their representatives.
